Alcohol & Cereal Malt Beverage Licenses

Alcohol and Cereal Malt Beverage licenses and permits are regulated by Title 5 of the Shawnee Municipal Code.  Below is detailed information for each type of license. Contact the Community Development Department at (913) 742-6247 for more information.

Alcohol Liquor License (Liquor Store)

A valid Alcoholic Liquor license is required for any person or business to sell alcoholic liquor, including beer containing more than 3.2% alcohol by weight, for consumption off the premises and/or in the original package. Effective April 1, 2019, an Alcoholic Liquor Retailer License shall also permit the sale of CMB.

Regulations

  • Must have a valid Liquor Licenses from the State of Kansas, Department of Revenue, Alcoholic Beverage Control Division. The Alcoholic Beverage Control Division can be contacted at (785) 296-7015 for questions regarding the State license.
  • Sales to anyone under the age of 21 are not allowed.
  • Sales of package alcoholic liquor are allowed during the following times:
    • Every Monday through Saturday: 9:00 a.m. to 11:00 p.m.
    • Every Sunday, except Easter Sunday*: 9:00 a.m. to 8:00 p.m.
      • *Sales are not permitted on Easter Sunday, Thanksgiving Day or Christmas Day.
  • No license for the retail sale of alcoholic liquor be issued to any person whose proposed place of business is within two hundred feet of any public or parochial school, college or church except that if such school, college or church is established within two hundred feet of any licensed premises after the premises has been licensed, the premises shall be an eligible location for licensing retailers of alcoholic liquors.
  • All licenses are biennial and begin on January 1.
  • Renewal licenses must be submitted no later than December 1.
  • No Smoking is allowed on the premises.

Caterers License

A caterer is an individual, partnership or corporation which sells alcoholic liquor by the individual drink and provides services related to the serving thereof, on unlicensed premises which may be open to the public, but does not include a holder of a temporary permit selling alcoholic liquor in accordance with the terms of such permit.

Regulations

  • Must have a valid Caterer's licenses issued by the State of Kansas, Department of Revenue, Alcoholic Beverage Control Division. The Alcoholic Beverage Control Division can be contacted at (785) 296-7015 for questions regarding the State license;
  • Must have a local Caterer's license issued by the Community Development Department;
  • No serving, mixing or consumption of alcoholic liquor or cereal malt beverage between the hours of 2:00 a.m. and 6:00 a.m. on any day an event is catered by such caterer.
  • No alcoholic beverages or cereal malt beverages shall be given, sold or traded to any person under twenty-one (21) years of age.
  • Prior to any event at which a caterer will sell or serve alcohol by the individual drink, the caterers shall notify the Chief of Police in writing at least five (5) working days prior to the event if the event will take place within the corporate City limits. The notice shall contain the location, name of the group sponsoring the event, and the exact date and times the caterer will be serving.
  • All licenses are biennial and begin on January 1.
  • Renewal licenses must be submitted no later than December 1.

Cereal Malt Beverage (CMB) License

A valid Cereal Malt Beverage (CMB) license is required for any person or business to sell CMB in the City of Shawnee. CMB is defined as any fermented but undistilled liquor brewed or made from malt or a mixture of malt and/or malt substitute, but does not include any such liquor, which contains more than 3.2% alcohol, by weight. 

Effective April 1, 2019, a license to sell CMB shall also permit the sale of beer containing not more than 6% alcohol by volume.

General Regulations

  • All CMB licenses must be approved by the Governing Body
  • Any business wanting to sell cereal malt beverages must first obtain a business license.
  • Post your license conspicuously in your business;
  • Notify the City Clerk of any changes in the manager, owner or incorporators of the licensed business;
  • Provide access to law enforcement officers for enforcement purposes at all times during business hours;
  • Make sure customers are off the premises prior to and not later than 1/2 hour after the legal hour of closing;
  • No CMB shall be given, sold or traded to any person under twenty-one (21) years of age;
  • No license will be issued to a business within 300 feet of any school, college, or church; and
  • The license is non-transferable.

Regulations for Businesses licensed to sell packaged beer (off-premises consumption):

  • Sales of package beer for off-premises consumption are allowed during the following times:
    • Every Monday through Saturday: 6:00 a.m. to midnight
    • Every Sunday, except Easter Sunday*: 9:00 a.m. to 8:00 p.m.
      • *Sales are not permitted on Easter Sunday

Regulations for Business licensed to sell beer for consumption on the premises:

  • Sales of beer for on-premises consumption are allowed during the following times:
    • Every Monday through Saturday: 6:00 a.m. to midnight
    • Every Sunday*: 6:00 a.m. to midnight
      • *In order to sell on Sunday, you derive 30% or more of your gross receipts from the sale of food.

Applications
It takes approximately 25 days to process cereal malt beverage licenses after the appropriate applications and fees have been submitted to the Community Development Department at City Hall.

Fees

  • On-premise consumption: $150.00 City fee plus $25.00 State fee equals $175.00 total fee
  • Off-premise consumption: $50.00 City fee plus $25.00 State fee equals $75.00 Total fee
  • Fees are non-refundable and no prorated fee is available.
Drinking Establishment License

A valid Drinking Establishment License is required for any restaurant, bar or premise which may be open to the general public, where alcoholic liquor by the individual drink is sold.

Regulations

  • Must have a valid Drinking Establishment Licenses issued by the State of Kansas, Department of Revenue, Alcoholic Beverage Control Division. The Alcoholic Beverage Control Division can be contacted at (785) 296-7015 for questions regarding the State license.
  • Must obtain a local Drinking Establishment license issued by the Community Development Department.
  • Must obtain zoning approval from the Planning Department. Zoning restrictions dictate the locations of Drinking Establishments.
  • Drinking establishments serving food must contact the Johnson County Health Department at (913) 715-6900 for additional permits and/or licenses.
  • No sales between the hours of 2:00 a.m. and 6:00 a.m. on any day of the week.
  • Cereal malt beverages may be sold on the premises licensed for the retail sale of cereal malt beverage for on-premises consumption at any time when alcoholic liquor is allowed by law to be served on the premises.
  • No alcoholic beverages shall be given, sold or traded to any person under twenty-one (21) years of age.
  • All licenses are biennial and begin on January 1.
  • Renewal licenses must be submitted no later than December 1.

Drinking Establishment License biennial fee is $500.

Private Club License

There are two categories for private clubs: Class A and Class B. A Class A club means a premises which is owned or leased by a corporation, partnership, business trust or association and which is operated thereby as a bona fide nonprofit social, fraternal or war veteran's club, as determined by the State of Kansas, for the exclusive use of the corporate stockholders, partners, trust beneficiaries or associates, and their families and guests accompanying them. A Class B club means a premise operated for profit by a corporation, partnership or individual, to which members of such club may resort for the consumption of food or alcoholic beverages and for entertainment.

  • Must have a valid Private Club licenses issued by the State of Kansas, Department of Revenue, Alcoholic Beverage Control Division. The Alcoholic Beverage Control Division can be contacted at (785) 296-7015.
  • Must obtain a local Private Club licenses issued by the Community Development Department.
  • Must obtain zoning approval from the Planning Department. Zoning restrictions dictate the locations of Drinking Establishments.
  • Drinking establishments serving food must contact the Johnson County Health Department at (913) 715-6900 for additional permits and/or licenses.
  • No sales between the hours of 2:00 a.m. and 6:00 a.m. on any day of the week.
  • Cereal malt beverages may be sold on the premises licensed for the retail sale of cereal malt beverage for on-premises consumption at any time when alcoholic liquor is allowed by law to be served on the premises.
  • No alcoholic beverages shall be given, sold or traded to any person under twenty-one (21) years of age.
  • No Smoking is allowed on the premises unless an exemption was granted by the Kansas Department of Health and Environment.
  • All licenses are biennial and begin on January 1.
  • Renewal licenses must be submitted no later than December 1.

Temporary Alcohol Permit

A valid State and City temporary alcohol permit is required to sell or serve alcoholic liquor at an event or in an area that is not physically attached to a licensed premises. If an event is held and alcoholic liquor is sold and the event or area in which the event is held is physically attached to a licensed premises, no temporary alcohol permit is required; however, an "Extension of Premises" is required from the Department of Revenue, Alcoholic Beverage Control Division, 915 S. W. Harrison St., Topeka, KS 66625, (785) 296-7015. A temporary alcohol permit is not required for the serving of complimentary alcoholic liquor or cereal malt beverages at fund raising activities of charitable organizations or political committees.

Regulations
Must have a valid Temporary Alcohol permit issued by the State of Kansas, Department of Revenue, Alcoholic Beverage Control Division. The Alcoholic Beverage Control Division can be contacted at (785) 296-7015 for questions regarding the State license;

  • Must obtain a local Temporary Alcohol permit from the Community Development Department. It is unlawful for any person to conduct an event under a State issued temporary permit without applying for a local temporary permit at least five (5) days before the event.
  • No temporary permit holder shall allow the serving, mixing or consumption of alcoholic liquor or cereal malt beverage between the hours of 2:00 a.m. and 9:00 a.m. at any event for which a temporary permit has been issued.
  • No alcoholic beverages shall be given, sold or traded to any person under twenty-one (21) years of age.

Fees
The fee is $25 per day (three-day max).
