D. NEW BUSINESS

CHAIRMAN BOGINA: Paul.

PLANNING DIRECTOR CHAFFEE: (Inaudible reading of the staff report) This request is to withdraw the previously issued special use permit issued to Angie Doherty to operate an athletic club in the Oak Valley Shopping Center, located 5562 Hedge Lane Terrace. Recent amendments to the Zoning Rules and Regulations no longer require a special use permit for an athletic club containing less than 3,000 square feet.

Planning staff recommends withdrawal of SUP-01-15-01 a special use permit issued to Angie Doherty to operate Right FIT Fuel and Fitness, an athletic club, located at 5562 Hedge Lane Terrace, since the Zoning Rules and Regulations no longer require a special use permit.

CHAIRMAN BOGINA: Thank you. Any questions for the staff? If not, Commissioner Busby do you have a motion?

COMMISSIONER BUSBY: Yes, move for withdrawal of SUP-01-15-01, special use permit for Right FIT Fuel and Fitness athletic club, 5562 Hedge Lane Terrace.

CHAIRMAN BOGINA: Thank you. Commissioner Peterson.

COMMISSIONER PETERSON: I second the motion.

CHAIRMAN BOGINA: There’s a motion and second to withdraw previously issued special use permit issued to Chris and Angie Doherty for Right FIT Fuel and Fitness, all in favor?

COMMISSIONERS: Aye.

CHAIRMAN BOGINA: Opposed? Motion passes.

(Motion passes 11-0)

CHAIRMAN BOGINA: That takes us to:

E. OTHER BUSINESS

CHAIRMAN BOGINA: Paul.

Planning Director Chaffee reminded the Commission that the second meeting in February will be on a Wednesday due to the President’s Day Holiday; the Commission will be receiving an invitation to the Shawnee Tomorrow reception on February 4, 2016 at Johnny’s (Tavern) following City Day, please RSVP.

CHAIRMAN BOGINA: Thank you. Does the Commission have any business for the staff? Commissioner Busby.

COMMISSIONER BUSBY: Thank you, Mr. Chairman. A couple things, if my memory serves me correct, having wall board type signs in Windows of businesses is not exactly what we like around here? I thought they couldn’t put signs in their windows, is that correct?

PLANNING DIRECTOR CHAFFEE: You can have up to 50% of your window area.

COMMISSIONER BUSBY: 50% of your window area, okay. Oh, it seems like we have proliferation of more and more signs in the windows now so that’s kind of disappointing because I think we went to that a couple years ago?

PLANNING DIRECTOR CHAFFEE: Correct.

COMMISSIONER BUSBY: So, that’s one thing, the other thing is that I would like for the Commission to revisit the exterior lighting of businesses, this was precipitated by me seeing the building up on 64th and Neiman with the lights that ended up to be Christmas lights, but with the new LED lights I’m wondering if we should, that we should go and look at what are coats for that are in revisit that.

PLANNING DIRECTOR CHAFFEE: We can do that.

COMMISSIONER BUSBY: Thank you.

CHAIRMAN BOGINA: Commissioner Peterson.

COMMISSIONER PETERSON: I have a quick question. Are you seeing those on, those signs more along Johnson Drive or Shawnee Mission Parkway, what area are you talking about?

COMMISSIONER BUSBY: Mostly on Shawnee Mission Parkway.

CHAIRMAN BOGINA: Does the Commission have any business for the staff?

F. ADJOURNMENT

CHAIRMAN BOGINA: If not, is there a motion to adjourn? Commissioner Braley.

COMMISSIONER BRALEY: I make a motion we adjourn this evening’s meeting.

CHAIRMAN BOGINA: Thank you. Commissioner Specht.

COMMISSIONER SPECHT: I second that motion.

CHAIRMAN BOGINA: Motion and second to adjourn, all in favor.

COMMISSIONERS: Aye.

CHAIRMAN BOGINA: Opposed? Motion passes, thank you.
